Banfana Media · Last updated August 2026 · Contact: [email protected]
These Terms of Use ("Terms") govern access to and use of the Banfana Attribution application, dashboards, reports, APIs, and related materials (collectively, the "Service"), provided by Banfana Media ("Banfana", "we"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not access or use the Service.
1. Limited, access-only license
Subject to these Terms, Banfana grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Service solely for your internal business purposes and only for the account(s) you are authorized to view. This is a right of access only. No ownership, title, or intellectual property right in the Service is transferred to you, and all rights not expressly granted are reserved by Banfana.
2. Proprietary rights
The Service — including its source code, user interface, visual design, layout, report formats, data models, methodologies, metrics, text, and all associated documentation (collectively, the "Proprietary Materials") — is the proprietary and confidential property of Banfana and is protected by copyright, trade secret, and other intellectual-property laws. The Proprietary Materials contain embedded provenance identifiers and watermarks; their presence in any other product is evidence of unauthorized copying.
3. Restrictions
Except as expressly authorized in writing by Banfana, you may not, in whole or in part:
- copy, reproduce, clone, republish, distribute, sublicense, sell, rent, lease, or host the Service or any part of it, or create any derivative or substantially similar work (including a look-alike dashboard, report, or interface);
- reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code, structure, design, or methodologies of the Service;
- scrape, crawl, or use bots or automated means to extract data or materials from the Service, or access it other than through the interfaces we provide;
- use the Service, its outputs, or any Proprietary Materials as input to, or as training, fine-tuning, or text-and-data-mining data for, any artificial-intelligence or machine-learning system;
- remove, alter, or obscure any copyright, trademark, watermark, or other proprietary notice; or
- use the Service to build a competing product or provide the Proprietary Materials to any third party.
4. Confidentiality
The Service and any non-public information you learn through it (including its methodologies, metrics, report structures, and any client data shown to you) are confidential information of Banfana and/or its clients. You agree to keep it confidential, to use it only as permitted under these Terms, and not to disclose it to any third party without Banfana's prior written consent.
5. Enforcement & remedies
Unauthorized copying, reproduction, reverse-engineering, or disclosure of the Proprietary Materials is a violation of these Terms and of applicable law, and may result in civil liability and other penalties. You acknowledge that any such breach may cause irreparable harm for which monetary damages would be inadequate, and that Banfana is entitled to seek injunctive relief in addition to any other remedies, and to pursue any violation to the fullest extent permitted by law. Banfana may suspend or revoke your access at any time.
6. No warranty
The Service is provided "as is" without warranties of any kind, whether express or implied, including fitness for a particular purpose. Attribution and reporting outputs are estimates and should not be relied upon as the sole basis for any financial, legal, or business decision.
7. Governing law
These Terms are governed by the laws of the State of [•], without regard to its conflict-of-laws rules, and any dispute will be subject to the exclusive jurisdiction of the courts located in [•]. (Placeholder — to be set with counsel.)
8. Changes
We may update these Terms from time to time; the date above reflects the latest version. Continued use of the Service after a change constitutes acceptance of the updated Terms.
